Minutes of the Special Meeting of the Town of Webster Board of Supervisors
Call to Order: Meeting called to order at the Webster Town Hall by Chair Oliphant at 7:00 PM. All board members were present, except for Jan Parker, Treasurer, who arrived later. With town residents and others, sixteen people were in attendance.
Pledge of Allegiance: The Board led the crowd in reciting the Pledge of Allegiance.
Proof of Posting: Clerk Yttri attested to the proper posting in two newspapers for two weeks in addition to posting at the three designated locations and on the website.
Reading of the Ordinance: Chair Oliphant read an introduction to the proposed ordinance and asked if anyone present would like a reading of the proposal in its entirety. Residents attending agreed that they had previously read the proposal. Several copies were distributed to residents who did not bring their own copies.
Motion to Adopt: No resident made a motion to adopt the driveway proposal as written, but several expressed interest in moving on to the discussion phase so as to be able to provide input.
Discussion: Resident Paul Bader expressed opposition to the ordinance as written for two main reasons:
1) The 50 foot horizontal area and 10% slope requirements are not applicable to our geography in the Town of Webster.
2) The proposed ordinance attempts to regulate driveways beyond the town right of way, which oversteps the Town’s authority.
Resident Richard Appleman agreed, adding that the ordinance as written might restrict improvements made to properties within the Town and would therefore be counterproductive. Appleman asked whether the Board had researched other driveway ordinances from nearby Towns, such as Liberty and Franklin, stating he thought this proposal was more restrictive than most other Towns. Chair Oliphant responded that he had researched other driveway ordinances, and that parts of this proposal were based on the Town of Kickapoo’s driveway ordinance.
Resident Rogie Widner expressed opposition to some parts of the proposed ordinance. He suggested a 14% grade would be more realistic for our area than the proposed 10%. He also noted that in one area of the proposal, a 14 foot height clearance was listed and in another section, a 16 foot height clearance was stated. Widner also said he would like to see erosion control, including proper reseeding of the roadbank by the landowner, to be emphasized.
At that point, Chair Oliphant suggested that the ordinance be discussed section by section, so that compromises might be reached and a new proposal might be formulated.
Almost every resident in attendance then added constructive criticism, and after over an hour’s worth of working together, a new driveway proposal was hammered out.
Clerk Yttri will post the new driveway ordinance proposal on the website for public review of this draft. In addition, residents may request copies from the Clerk. He will begin preparing notices for a new hearing, scheduled for Tuesday, September 20, at 6:00 PM, prior to the regular monthly Board meeting.
Vote: There was no vote taken because of no motion to adopt. The greatest share of the meeting was spent in discussion and compromise, formulating a new proposed driveway ordinance.
Adjourn: Supervisor Nemec moved to adjourn the meeting. Supervisor Parker seconded, and the meeting was adjourned at 9:15 PM.
